better not open that can of worms......
THIS country was founded based on the legal premise that ALL power rested with the Congress. NOT the Senate, or the Court, or even the President. But with the House of Representatives. Furthermore, the States exerted full authority over the entire apperatus of the Federal Government, not the other way around.
It was, THESE United States up until the end of the Civil War, at which time it become THE United States.....and of course THE SEC. LOL

Sure it can change, if you do it as a democracy. It shouldn't be for the courts to decide.
Sorry...it doesn't work that way. Numerous policies, laws, etc. in place today are because of the courts. Some that come to mind: integration, interracial marriage, abortion, death penalty,

The Courts are supposed to interpret the laws, not legislate; that is done be Congress, or supposed to be. Most people were for integration, most people were for interracial marriage, most people are for the death penalty, but most people are against abortion, so the Court did override the public for one of those mentioned. Integration, interracial marriage, and the death penalty are covered in the Constitution by the right to life, liberty, and persuite of happiness, along with the First Ammendment. Abortion isn't justifiable by anything in the Constitution.
